Agreement to Terms
Welcome to YourWebDesign. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services Provided
YourWebDesign provides professional web design and development services, including but not limited to:
- Custom website design and development
- Responsive web design for all devices
- E-commerce solutions
- Content management systems
- Website maintenance and support
- Custom web applications
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information for your project
- Respond to requests for feedback and approvals in a timely manner
- Provide all necessary content, images, and materials required for the project
- Ensure you have the legal right to use any materials you provide
- Make payments according to the agreed schedule
- Communicate professionally and respectfully
Project Quotes and Pricing
All project quotes are estimates based on the information provided at the time of quotation. Final pricing may vary if:
- Project scope changes or expands
- Additional features or functionality are requested
- Significant revisions beyond the agreed number are required
- Third-party services or licenses are needed
Any changes to pricing will be communicated and agreed upon before additional work is performed.
Payment Terms
Payment terms will be outlined in your project agreement. Standard terms include:
- A deposit (typically 50%) is required before work begins
- Final payment is due upon project completion and before website launch
- Payment methods accepted will be specified in your agreement
- Late payments may result in project delays or suspension
- Overdue invoices may incur late payment fees
Project Timeline
Project timelines are estimates and depend on:
- Timely provision of required materials and content
- Prompt client feedback and approval
- Project complexity and scope
- Unforeseen technical challenges
We will make every effort to meet agreed deadlines, but delays caused by client unavailability or late content provision may extend the timeline.
Revisions and Modifications
Each project includes a specified number of revision rounds as outlined in the project agreement. Additional revisions beyond this scope may incur extra charges. Major changes to project scope after work has begun may require a revised quote and timeline.
Intellectual Property Rights
Client Ownership
Upon full payment, you will own:
- The final website design and content specific to your project
- Custom graphics and assets created specifically for your website
- Website content you have provided
Developer Rights
YourWebDesign retains ownership of:
- Proprietary code frameworks and systems
- Design templates and methodologies
- Pre-existing code libraries and tools
- The right to showcase the completed project in our portfolio
Third-Party Components
Some projects may use third-party libraries, frameworks, or plugins, which remain the property of their respective owners and are subject to their own licenses.
Website Hosting and Maintenance
Unless otherwise specified:
- Website hosting is the client's responsibility
- We can recommend hosting providers or provide hosting services for an additional fee
- Maintenance and support packages are available separately
- Domain name registration and management are the client's responsibility
Warranties and Disclaimers
Our Warranty
We warrant that:
- Services will be performed with professional skill and care
- Websites will function as designed at the time of delivery
- Work will be original or properly licensed
No Warranty For
We do not warrant:
- Uninterrupted or error-free operation after third-party updates
- Compatibility with future browser or technology updates
- Results, traffic, or revenue from your website
- Third-party services or content provided by the client
Support and Maintenance
Post-launch support includes:
- Bug fixes for issues present at launch (typically 30 days)
- Basic guidance on using website features
Additional support, updates, and maintenance beyond this period are available through separate agreements.
Limitation of Liability
To the maximum extent permitted by law, YourWebDesign shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss or corruption
- Third-party claims
Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
Confidentiality
We respect your confidential information and agree to:
- Keep your business information confidential
- Not disclose client information to third parties without permission
- Use information only for providing agreed services
This does not apply to information that is publicly available or required to be disclosed by law.
Project Cancellation
By Client
If you cancel a project:
- Deposits are non-refundable
- You will be charged for work completed up to the cancellation date
- Any deliverables completed will be provided
By YourWebDesign
We reserve the right to cancel a project if:
- Payment terms are not met
- Client is unresponsive for an extended period
- Professional relationship cannot be maintained
In such cases, you will be charged only for work completed, and any unused deposit will be refunded.
Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or internet service failures.
Dispute Resolution
In the event of a dispute:
- Parties agree to first attempt resolution through good faith negotiation
- If negotiation fails, mediation may be pursued
- These terms are governed by the laws of England and Wales
- Legal proceedings will be subject to the exclusive jurisdiction of the courts of England and Wales
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes constitutes acceptance of the modified terms.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms of Service, together with your project agreement and our Privacy Policy, constitute the entire agreement between you and YourWebDesign regarding the use of our services.
